Application

As an employer, you apply for an employment permit or a guarantee certificate as a
particularly qualified skilled worker for the intended skilled worker at the competent regional Public Employment
Service, the AMS.

The permit is granted if:

• The worker has proven specialist knowledge, a high level of qualification and relevant professional experience
• A fixed-term employment relationship limited to the duration of the project is planned
• The labour market test carried out by the AMS shows that no domestic or already integrated worker registered
  with the AMS can be referred
• The applicable wage and working conditions are complied with

The maximum validity period of the employment permit is generally six months. An extension
is not possible.

Entry and residence

Depending on the planned duration of employment, the project employee requires a category C
or D visa.

The visa application must be submitted personally by the worker at the competent Austrian
representative authority abroad.

The visa is issued if:

• The general visa requirements are met
• A valid guarantee certificate from the AMS is available

Employment may only begin after the corresponding visa has been issued.

Fees

In individual cases, a reduced fee may apply to a category C visa if a corresponding EU visa facilitation agreement exists.
